The defendant is responsible for the sending of unsolicited text adverts to the claimant which are in breach of the Privacy and Electronic Communications Regulations 2003 sections 22 and 23, and ASA CAP codes 10.4.2, 10.6 and 10.13.3. Damages are claimed: (a) For the distress caused by the defendant's negligent and/or reckless disregard of the above regulations. (b) For the loss of utility and enjoyment of the claimant's phone due to spam filtering which has had to be in implemented due to unsolicited advertising. (c) For the time, money and effort spent to track down the defendant to ask them, and their lead broker, to stop. This effort was only necessary because the messages were anonymous in breach of regulations. (d) As an example to discourage this intrusive and illegal marketing technique.
